Terms and Conditions of 1800CPAP

Please Read Carefully

Welcome to 1800CPAP. By using the services we have provided you on the website 1800CPAP you are agreeing to the following terms with 1800CPAP, filed as a LLC in the state of Ohio as Ohio Sleep Awareness, LLC and the general principles for the websites of our subsidiaries and affiliates.

Prior to use of 1800CPAP website and services, you must read and accept all of the terms and conditions in this User Agreement. This agreement applies to any of Ohio Sleep Awareness, LLC (referred to throughout this document as 1800CPAP.COM or 1800CPAP) domains and sub-domains. This Agreement is effective 8/1/2012

Please Read carefully (excluding international orders). Food and Drug Administration (FDA) classify CPAP/Bi-PAP/Bi-Level machines, complete assembled CPAP masks and humidifiers as Class II Medical Devices that require a copy of the prescription be on file prior to shipping your order to any U.S. address(Please Note: You may order prior to submitting your prescription, it will ship once we have it on file). If you do not have a copy of your CPAP prescription, do not worry because you still have many options, simply contact a CSR at 1-800-274-1366 for assistance. Please note we set the therapy devices (CPAPs) to the settings listed on the prescription prior to shipping.

Customs and International Shipments

You may be contacted by your local custom's department to provide additional documentation once they receive your shipment.

Please note: It is solely the responsibility of the customer to provide any necessary documentation if requested by your country's customs department. Failure to do so can and will result in your shipment being held by your local customs until the necessary documentation has been provided. You may not always be required to provide additional documentation by your customs (this decision is made by your country's customs department).

Once your shipment leaves our facility, we no longer have any control over it (especially when dealing with customs).

If you have any issues, please contact your customs department and/or shipping carrier directly. And of course, you can always reach out to the 1800CPAP customer service team as we are happy to help you get your shipment cleared.

Warranty Items

If the product you have purchased needs to be returned due to a manufacturer defect, 1800CPAP will exchange your product for the same item or an item of equal value at no additional charge (international shipping rates may apply on orders outside the continental U.S.). All customers (International and Domestic) should contact a 1800CPAPCustomer Service Agent to obtain an approved RMA number for the return. Approved RMA return items must be received by 1800CPAP within 45 days of the RMA issuance, in order to be valid for warranty consideration. 1800CPAP does offer extended warranty plans on certain items.

What Happens If I Order The Wrong Part or Size?

Important note: We cannot accept returns for opened products.

1800CPAP will exchange your item for correct item minus the price difference; meaning you only pay the difference or we will offer you store credit for the difference based on the cost of the purchased item versus the exchanged item. The cost of shipping your returned item(s) back to 1800CPAP will be the responsibility of the customer. There are no restocking fees on exchanged items as long as the products have not been opened. If you open the package, we cannot accept the return. Therefore, it is important that you take your time picking the right product and size. You can contact us for advice or download the sizing guides located at the bottom of this web page under the customer support tab.

Returning My Order

1800CPAP will accept returns for purchases made through 1800CPAP on unopened product(s) within 45 days of the date of purchase (not delivery), with an approved RMA number. All customers (International and Domestic) should contact a 1800CPAP Customer Service Agent to arrange for an approved RMA number. Approved RMA return items must be received by 1800CPAP within 45 days of the RMA issuance, in order to be valid for return consideration. A restocking fee of 5% will be subtracted from the original charges and a store credit for the difference will be issued on returned items, not exchanged items. There is NOT a 15% restocking fee on exchanged items. All shipping costs are non-refundable.

Manufacturer Defects

1800CPAP will accept returns on products you purchase that have manufacturing defects. If the product you purchased has defective materials and/or workmanship, please contact us first for trouble shooting and then, if required, a return authorization number will be issued to you. Please note that any associated shipping cost to return products to 1800CPAP is not covered for any warranty or return circumstance.

Opened Items

1800CPAP will not accept returns on products that have been opened. We recommend that you take precautionary measures to insure you are purchasing the right style and size masks for you. For your convenience, we make available to you a detailed product page and mask sizing gauges (when available).

Canceling My Order

Please note: Once your order has left our facility it can no longer be cancelled.

In most cases we can cancel your order with no additional fees, as long as your order hasn't left our facility. At the time of order placement a pending hold is placed on your credit/debit card or PayPal account for the amount of your order. Upon cancellation this pending charge will simply fall off within 72 business hours. You won't see a refund in your account since we don't fully capture payment until the time your order is shipped. In rare cases we may fully bill your order before shipment, in which case you will see a refund of the charges upon cancellation. We often fulfill orders quickly so in many cases once you place an order you have a very limited amount of time to cancel before it ships.

Please be sure to check your items carefully before order submission. Upon delivery, if a product discrepancy does occur with your order, it must be reported within 30 days of receipt in order to be considered for review and validation.

Important Information

Product lines vary from manufacturer to manufacturer and your mask sizes may differ. Example: A medium mask size for one style may be a large for another, please refer to the mask sizing gauges available (you can always email us to make sure).

We do consider all machines used if opened and if usage hours are placed on the machine. CPAP and BI-Level/Bi-PAP warranty decisions for repair or replacement are made by solely by the manufacturer.

All Machines (CPAP, Bi-Level, Bi-PAP, VPAP Adapt SV, Bi-PAP AutoSV, AutoPAP etc.,) which are experiencing functional issues and are no longer under manufacturer warranty MAY be able to repaired by the manufacturer. This policy varies by manufacturer. A diagnostic fee (which varies and is determined by the manufacturer), which may or may not be applied to the actual repair cost (depending on the manufacturer) will be collected prior to submitting the machine to the manufacturer for assessment.

Use of Our Site

While using the services and website of 1800CPAP, you are prohibited/restricted from:

  • Register or use any email address that you do not own or for which you do not have the express permission of the owner to register with.
  • Duplicate, change, or disseminate content and our copyrights and trademarks; gather, compile, or in any way collect information about users, including email addresses, without first obtaining such user's express consent;
  • Posting inappropriate content, violating any laws, third party rights or any of our policies;
  • Use 1800CPAP, if you are below the age of 18, if you are unable to form legally binding contracts.
  • Manipulate the list price of any product, service or item listed on the website
  • Post false, inaccurate, misleading, defamatory, or libelous content (including personal information);
  • Distribute or post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, or pyramid schemes;
  • Impersonate any person or entity, including without limitation a 1800CPAP employee or agent, or otherwise misrepresent your affiliation with any person or entity;
  • copy information from our website including (but not limited to) images and text content
  • the use of bots or computer programs to gather or scrape information from our website for the purposes of (but not limited to) unauthorized re-distribution and competitive analysis.
  • the use of bots or computer programs to automatically place orders.

1800CPAP has the right to suspend, deactivate, limit, or cancel our service and user accounts, impede or restrict access to our website in our sole discretion. 1800CPAP reserves the right to refuse service to anyone. We may, at our sole discretion, label or categorize any customer or user account "Refuse to Provide Service". Should this occur, we will continue to provide warranty and other related services as required by law, however we will not sell any further products to the "Refuse to Provide Service” customer.

Public Content

By submitting communications or content to any part of 1800CPAP or its domains and sub-domains where content may be viewable by the public (e.g. posting on a discussion forum, chat or other public communication), you agree that such communication is non-confidential for all purposes. Any submission to this Web site will be deemed and remain the property of 1800CPAP.


Unless otherwise indicated, all information contained on this web site, such as images, advertisements, logos, original content, text, graphics, audio clips, videos are copyrighted by and proprietary to Ohio Sleep Awareness, LLC (1800CPAP), and may not be copied, reproduced, transmitted, displayed, performed, distributed, sublicensed, altered, stored for subsequent use or otherwise used in whole or in part in any manner without our prior written consent. We may also use third party content, information, images, or videos from manufacturers for marketing or informational purposes of the products we advertise for sale of or product information.

Medical Advice

You recognize and agree that the content made available through 1800CPAP is for informational purposes only and is not intended to be taken and should not in any way be construed as medical advice or counseling or as the practice of medicine. Users should never use any 1800CPAP resources in place of seeking professional advice from a licensed medical practitioner. We make no guarantees, promises, or predictions of success regarding any of the services or resources offered through 1800CPAP.

Restrictions of Service

We reserve the right to refuse service to anyone at anytime at our discretion. In the case where we discontinue service we will continue to honor any warranty obligations as required by law. 1800CPAP has the right to refuse service to employees, agents or persons working on the behalf of ResMed employees, owners, or board of directors. Furthermore, ResMed employees, agents, or persons purchasing on behalf of ResMed employees or agents agree that items purchased from 1800CPAP are not to be used to indicate or identify distributors of ResMed products to 1800CPAP. Indications that a purchase has been made with the intention of identifying ResMed distributors by the above listed ResMed agents or employees of ResMed shall result in the refusal of product as well as monetary forfeiture.

International Orders

The customer is responsible for determining, managing and paying any and all taxes, duties and import fees (if applicable) associated with the purchase or transaction through 1800CPAP. We are unable to provide payment or quotes of payment for taxes or duties. We will accept International prescriptions if the customer and prescribing doctor are residents of the same country and the prescription provided meets the guidelines set forth by the country of origin. When required, prescriptions do not have to be in English, however we reserve the right to request a translation if deemed necessary. 1800CPAP reserves the right to refuse any order it determines does not meet our requirements.

Warranties will be honored on all products purchased through 1800CPAP however the customer is responsible for any and all shipping charges related to returning an item for repair, replacement, or service and if necessary, any and all shipping charges for sending product(s) back to the customer.

Liability Limitations

1800CPAP will not be held responsible by you for other user's actions or inactions, including things posted by said users. Additionally, in no event shall 1800CPAP guarantee constant or secure access to our websites or services, and normal functioning of 1800CPAP may be interfered with or disrupted by numerous factors beyond the scope of our control. Also, according to the fullest extent permitted by law, we exclude all implied warranties, terms and conditions. We are not liable for any loss of money, goodwill, or reputation, or any special, indirect, incidental or consequential damages arising out of your use of 1800CPAP. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.


You agree to release 1800CPAP, trustees, officers, agents, directors, subsidiaries, joint ventures and employees from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, real or imaginary, arising out of or in any way connected to a dispute with 1800CPAP.

Typographical Errors

In the event a product or service is listed at an incorrect price due to typographical error or error in pricing information received from our suppliers, 1800CPAP shall have the right to refuse or cancel any orders placed for the product or service listed at the incorrect price. We also have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, 1800CPAP shall issue a credit to your credit card account in the amount of the incorrect price. 1800CPAP attempts to be as accurate as possible. However, we do not warrant that product descriptions or other content on this site is accurate, complete, reliable, current, or error-free.

Risk of Loss

All items purchased are made pursuant to a shipment agreement. This means that the risk of loss and title for such items pass to you upon our delivery to the carriers (FedEx or USPS). Please refer to our shipping policy page for more information.

Health Insurance Information

1800CPAP currently does not accept Health Insurance. We are not a provider for any insurance company or health care organization. We do not file any insurance claims for any reason. You may be eligible to submit a claim to your provider on your own behalf if you have out of network benefits. We do our best to provide you with the billing codes to make these submissions. We DO accept HSA and Flexible Spending Account cards for payment of services or products.

1800CPAP (Ohio Sleep Awareness, LLC) sells sleep apnea related equipment to customers for cash/credit charge. We are a private pay site. We do not work with private or government based insurers or social benefit programs. 1800CPAP is not a Medicare provider nor do we have a Medicare contract to provide services. Medicare will not reimburse you for purchases you made through 1800CPAP.

Pre-Owned/Refurbished/Open Box Items

1800CPAP offers a selection of new and used CPAP equipment. 1800CPAP takes all the appropriate measures to disinfect and insure cleanliness and functionality of our pre-owned/refurbished/open box items. You agree to release 1800CPAP, trustees, officers, agents, directors, subsidiaries, joint ventures and employees from claims, demands and damages (actual and consequential) of every kind and nature resulting from the use of a purchased or donated Pre-Owned, Refurbished, Open Box Special sleep apnea equipment device not limited to CPAP. Please review the warranty information listed on the specific product page for more information, as these products may have varying warranty periods and/or terms.
